Introduction

This Privacy Policy forms a part of our Terms and Conditions (‘Terms’) and governs your use of the DreamPlay platform, including its websites, mobile applications, features, services, content, and related functionalities (collectively, the ‘Platform’).

DreamPlay is operated by Sporta Technologies Private Limited. Any person accessing or using the Platform or any of its services (‘Services’) shall be bound by this Privacy Policy. Sporta Technologies Private Limited referred to herein as “Dream Play”/Company or “We/we” or “Us/us” “Our/our”.

Any person utilizing the Platform ("User" or "You/you" or "Your/your") or any of its Services offered on the Platform shall be bound by the terms of this privacy policy (“Privacy Policy”).

 

All capitalised terms not defined herein shall have the meaning ascribed to them in the Terms.

 

Dream Play respects the privacy of its Users and is committed to protecting it in all respects. With a view to offer an enriching and holistic internet experience to its Users, Dream Play offers a vast repository of Services. Depending on Your region and the features You choose, the Services may be provided free of charge or on a paid basis.  

 

Before You submit any information on the Platform, please read this Privacy Policy for an explanation of how We will treat Your information. By using any part of the Platform, You consent to the collection, use, processing, storage, disclosure and transfer of Your information for the purposes outlined in this Privacy Policy and to the collection, processing, storage and maintenance of this information. Your use of any part of the Platform indicates Your acceptance of this Privacy Policy and of the collection, storage, use and disclosure of Your information in accordance with this Privacy Policy.

 

While You have the option not to provide Us with certain personal information, withdraw Your consent to collect certain information, request temporary suspension of collection of personal information or request deletion of personal information collected, kindly note that in such an event You may not be able to take full advantage of the entire scope of features and services offered to You and We reserve the right not to provide You with Our Services.

 

In the ever-evolving medium of the internet, We reserve Our right to periodically review and change Our Privacy Policy to incorporate such future changes as may be considered appropriate under applicable laws. Any changes to Our Privacy Policy will be posted on this page, so You are always aware of what information We collect, how We use it, how We store it and under what circumstances We disclose it.

Collection of Data

To avail Services on the Platform, Users may be required to create an Account using third-party sign-in services, such as Google Sign-in or Sign in with Apple (“Social Login”) or any other login credentials required by the Platform. For this registration process We may collect and process the following types of information:

(a) Information You Provide

Information you provide directly to us when you register, create or update your account, use social login features, communicate with us, or otherwise interact with the Platform, including your name, username, email address, phone number, location (state/country), and any other information you choose to provide.

(b) Sensitive Personal Information (SPI)

In certain cases, we may collect and process sensitive personal information (‘SPI’), including financial information (such as payment instrument details), and other information that may be subject to enhanced protections under applicable law. Such information is collected only where necessary and processed in accordance with applicable legal requirements.

(c) Automatically Collected Information

We automatically collect certain technical and usage information, including device identifiers, IP address, browser type, app version, operating system, log files, interaction data, cookies, diagnostics and crash data, and location data where enabled.

(d) Information from Third Parties

We may receive information from third parties, including social login partners (such as Google, Apple, or Facebook), payment processors, analytics providers, advertisers, and publicly available sources.

If the Services do not require payment or account creation, We may process limited device/network data for security, fraud prevention, diagnostics, and analytics. You may, however, provide Us with personal data if and when You:

  1. Enter a promotion or survey; or
  2. otherwise interact or correspond with Us ( including via email or social media)

If You do not need to register an Account or make any payment to use the Services, We will not require Your identity/registration information for providing access to the Platform. We may process limited device and network data (e.g., IP address, device identifiers, app/OS version, diagnostics), approximate location derived from IP for security/rights-based blackouts, and cookies/consent preferences on web (if applicable). If You voluntarily provide contact details (e.g., to receive alerts or support), We will use them only for that purpose and as otherwise described here.

By using the Platform, You hereby expressly agree and grant consent to the collection, processing, use and storage of your information by Us.

 

To the extent applicable, We follow data minimisation and collect only what is necessary. We may collect and use personal information provided by You to operate, provide, develop, and improve Our Services, keeping you informed of Our offerings, and the products and/or services of Our affiliates and group entities, and to enable Our affiliates and group entities to reach out to You.  You agree to give Us the permission to capture and record Your device related information, operating system information, network information, location information etc. You may choose to allow Us to gather information in relation to the apps installed on Your device in order for Us to better our Services and Your experience on the Platform.

You must be of legal age as per applicable law to use the Platform. If we become aware that personal information has been collected from an individual who does not meet the minimum age requirement, we will take reasonable steps to delete such information in accordance with applicable law.

Usage and Disclosure

We will use Your personal data where applicable laws allow us to. As per applicable data-protection laws, We collect and use Your personal data for:

  • Service Provision: to provide, operate and improve our Services to you. This includes creating and managing your account, verifying your identity and eligibility to engage with features on the Platform, personalising your experience, improving performance, developing new products or content experiences, and communicating with you about updates, service messages, security alerts, promotions or recommendations. 
  • We may also use your information to keep you safe on the Platform. This includes detecting, identifying, preventing and mitigating any fraud or misuse we find that relates to you, ensuring compliance with applicable law, and to maintain the safety and integrity of the Platform. We may also use your personal information to conduct analytics, ensure Platform security, perform market research; and prevent fraud or illegal activity.

We may also rely on your personal information to send you marketing communications, process specific special categories of data (if collected), or utilize certain non-essential cookies (if applicable). 

We use automated processing, including profiling, to analyse user-related data (such as videos, activity data, metadata, and profile information) in order to generate performance analytics, skill scores, personalised insights, recommendations, and reports.

As a user, you have certain rights in relation to your personal data. These rights include the right to access your personal data, the right to rectify inaccurate or incomplete data, the right to request erasure of your personal data, the right to restrict the processing of your personal data, the right to data portability where applicable, the right to object to processing (including objection to direct marketing or certain forms of profiling), and the right to withdraw your consent at any time where processing is based on consent. To exercise any of these rights, please contact us using the details provided in this Privacy Policy. We may need to verify your identity before responding to your request.

International Transfers of Personal Data

Your personal data may be transferred to, stored in, or processed in countries outside your country,  where our servers, group companies, or service providers may be located.

We ensure that any cross-border transfers are subject to appropriate safeguards and comply with applicable data protection laws.

Communication and Unsubscription

You understand that once you have shared your user account information and successfully registered on the Platform, you may receive SMS or email notifications from Dream Play relating to your registration and transactions on the Platform. Where processing is based on your consent, you may withdraw such consent at any time through your account settings or by contacting us. Please note that withdrawal of consent may impact the availability of certain features or services on the Platform.

You may also receive such notifications regarding any marketing / promotional activities that maybe available on the Platform from time to time. By accepting these Terms, you explicitly consent to receive news, updates, offers/ campaign, marketing/ promotional communications (through call, SMS, email or other digital and electronic means) from us and/or our authorized representatives regarding any new services or offerings, even if your contact number is registered under the DND/NCPR list under the Telecom Commercial Communications Customer Preference Regulations, 2018.

You can unsubscribe / opt-out from receiving marketing/ promotional communications, newsletters and other notifications from us at any time by following the instructions set out in such communications.

Information sharing

We may share your personal information with:

  • Affiliates and Group Entities: We may share your information, such as data provided by you or concerning your usage of the Services, with our group entities and affiliates so they can help deliver and improve our Services, support your operations, conduct analytics, or  contact you regarding any products or services offered by them, or to support our internal functions, compliance requirements, and business operations.
  • Service Providers/Data Processors, who are trusted third parties (such as payment processors, cloud hosting providers, customer‑support vendors, and data analytics companies) who perform services on our behalf. These partners act as Data Processors and are under strict confidentiality and security obligations to process your information securely and only in accordance with our documented instructions, this Privacy Policy, and applicable law. They may access or process such information only for purposes consistent with this Privacy Policy.
  • Commercial and Marketing Partners to track and measure your engagement, marketing and promotional activities, or to deliver relevant and personalized ads or promoted content to you. Note that these data sharing activities are undertaken in compliance with applicable law, and where possible, we will provide you with an ability to opt-out of this sharing.
  • Business Transfers: In the event of a sale, merger or transfer of all or part of our business, your information may be part of the transferred assets. We do not sell your personal information, but may be required to transfer it as part of the business arrangements described above. 
  • Law Enforcement and Legal Requests: We may be required to share your information when required by law, court order, government or regulatory request, or to protect our rights and those of our partners or Users, or to prevent harm or fraud on our Platform or to respond to requests from entities that support fraud detection, security, dispute resolution, or compliance functions.
  • We may share User Content and Company Content - including DPR and performance analytics generated from your match sessions, with tournament organiser or sports venue operators who have sought Dream Play’s services for the purpose of recording, processing, and analysis of match sessions at their facilities ("Partners"). Company Content may be shared with Partners for purposes connected to or reasonably arising from their role as a Dream Play partner venue, including without limitation: (i) managing and improving the player experience and quality of play at their facility; (ii) communicating with players regarding their performance, rankings, session history, or participation opportunities at that venue or across affiliated venues; (iii) organising, administering, or facilitating participation in tournaments, events, leagues, or competitive programmes, whether at a single venue or across multiple Partner venues within a region; (iv) identifying and inviting players based on their skill level, ranking, or performance metrics for participation in such programmes; and (v) any other purpose reasonably necessary for the internal management and operation of their facility or their participation in the Dream Play partner network. Partners are not permitted to use DPRs for independent commercial exploitation, disclosure to unaffiliated third parties outside the Dream Play partner network, or the development or training of machine learning or artificial intelligence systems, without the prior written consent of Dream Play.

The Company reserves the right to commercialise Company Content including data and insights derived from match sessions, performance analytics, skill scores, DPRs, usage patterns, and other content generated on or through the Platform ("Anonymised Data"), including by licensing or otherwise making available such Anonymised Data to third parties. Prior to any such commercialisation, the Company shall ensure that such data is anonymised such that it does not constitute personal data of the User. The Company does not sell personal data. The Company's right to commercialise Anonymised Data is not affected by, and shall survive, the deactivation, deletion, or termination of your Account, provided that data derived from your sessions has been anonymised prior to such commercialisation. By using the Platform, you acknowledge and agree that the Company may exercise these commercialisation rights without further notice to or consent from you.

Community and Group Features

  1. Where you voluntarily opt in to community or group features on the Platform (including participation in third-party messaging groups such as WhatsApp), your contact details, including your phone number, may become visible to other participants in that community or group. Company does not independently "share" your contact details in such cases and visibility arises from your participation in the group itself. Participation is entirely voluntary, requires your affirmative action, and you may opt out at any time by contacting us at contactus@dreamplayai.com or through the relevant feature in the Platform. Opting out will result in your removal from the relevant group or community feature, and your contact details will no longer be accessible to other participants through that channel.
  2. You shall indemnify the Company against all types of losses and damages incurred by us due to any action taken by TRAI, Access Providers (as defined under the TRAI regulations) or any other applicable authority due to any erroneous complaint raised by You against us with respect to the communications mentioned above or due to an incorrect contact number or email address being provided by You for any reason whatsoever.

Links

We may also include links to other websites. Such websites are governed by their respective privacy policies, which are beyond Our control. Once the User(s) leaves Our servers (the User can tell where he/she is by checking the URL in the location bar on the User's browser), use of any information provided by the User is governed by the privacy policy of the operator of the site which the User is visiting. That policy may differ from Our Privacy Policy. If the User can't find the privacy policy of any of these sites via a link from the site's homepage, the User may contact the site directly for more information. We are not responsible for the privacy practices or the content of such third-party websites.

Security Procedures

We implement reasonable technical and organisational measures, including encryption, secure servers, access controls, and periodic security reviews, to protect your information. While we strive to protect your data, no system can be guaranteed to be completely secure, and we cannot ensure or warrant absolute security. Thus, We cannot guarantee the security of Our database, nor can We guarantee that information You supply will not be intercepted while being transmitted to Us over the internet. Further, any information You include in a posting to the discussion areas will be available to anyone with internet access.

Advertising

When We present information to Our online advertisers to help them understand Our audience and confirm the value of advertising on the Platform - it is usually in the form of aggregated anonymized data (information that cannot be used to trace a user) of User(s) that may include statistics and/or data concerning User traffic, User responsiveness and User behaviour to such advertisements on Our Platform. When You register with Us, We may contact You from time to time about updating Your content to provide features which We believe may benefit You.

Disclaimer

Beware of deceptive emails, websites, or messages claiming to be from or associated with Our Platform. These may misuse our name, logo, or content and attempt to collect personal information, payments, or promote unauthorized activities. Such communications are not connected to Us in any way. For Your safety, please verify authenticity before responding. We are not responsible for any loss or damage arising from reliance on such deceptive communications. Except as outlined in Our Terms, we will never ask You to share sensitive personal information.

Conditions of Use

WE DO NOT WARRANT THAT THIS PLATFORM, OUR SERVERS, OR EMAIL SENT BY US OR ON OUR BEHALF ARE VIRUS FREE. WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM OR RELATING TO THE USE OF THIS PLATFORM, INCLUDING, BUT NOT LIMITED TO COMPENSATORY, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL AND CONSEQUENTIAL DAMAGES, LOSS OR CORRUPTION OF DATA, GOODWILL, BUSINESS OPPORTUNITY, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES.

Retention of Data

We retain personal information only for as long as necessary to fulfil the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law, regulatory obligations, or for the establishment, exercise, or defence of legal claims.

Depending on your location, you may have the right to access, correct, update, delete, restrict, or object to the processing of your personal information, withdraw consent, and request data portability. Requests may be submitted through the support options available on the Platform (including by contacting us at contactus@dreamplayai.com), and we will respond within legally prescribed timelines.

User Account Deactivation, Deletion and Retention

We retain personal information only for as long as necessary to fulfil the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law, regulatory obligations, or for the establishment, exercise, or defence of legal claims.

Depending on your location, you may have the right to access, correct, update, delete, restrict, or object to the processing of your personal information, withdraw consent, and request data portability. Requests may be submitted through the support options available on the Platform (including by contacting us at contactus@dreamplayai.com), and we will respond within legally prescribed timelines.

Temporary Deactivation

Users may request temporary deactivation of their Account. During temporary deactivation:

  • you will not be able to log into or use the Platform; and
  • your account data and personal information will be retained in an inactive state.

You may request reactivation of a temporarily deactivated Account at any time, subject to verification, and your account data will be restored as it existed prior to deactivation.

Account Deletion and Grace Period

If you request deletion of your Account, your Account will be scheduled for deletion and you will lose access to the Platform and the Services.

Following your deletion request, your Account data will be placed into a restricted state and will no longer be actively processed. We retain such data for a limited grace period of up to one hundred and eighty (180) days to:

  • protect against accidental or unauthorised deletion requests;
  • allow you to cancel the deletion and reactivate your Account;
  • maintain the security and integrity of our systems; and
  • comply with applicable legal, accounting, or dispute-resolution obligations.

During this grace period, you may cancel the deletion and reactivate your Account by logging back in using your registered credentials. Customer support intervention is not required for such reactivation.

Once the grace period expires, your Account and associated personal information will be permanently and irreversibly deleted or anonymised, and reactivation will no longer be possible, except where retention is required by law.

Deletion Process and Backups

When you request deletion of your data, we follow a deletion process designed to ensure your data is securely and completely removed from our active systems or retained only in anonymised form.

Shared Match Videos

Match videos recorded on Dream Play courts capture the personal data of all players participating in the session. Because each video is shared across all participants in that session, it simultaneously constitutes the personal data of every player recorded in it.

Notwithstanding anything to the contrary contained herein, where one or more of the other players in your session have requested access to the video  whether to view it or to have it processed for their own analytics and performance statistics we will be unable to action your deletion request in full while those players retain a legitimate basis for continued access. This is because deleting the video would extinguish the independent rights of other identifiable Data Principals who share an equal interest in the same recording, for the same purpose for which it was collected. In such cases, we will:

  • Restrict use of your personal data to fulfilling the access and processing entitlements of the other players in your session, and for no other purpose; and
  • Action your deletion request (full deletion or anonymisation (where feasible)) in full once all other players in the session have either deleted the video from their accounts or their retention period has expired, and no further legitimate basis exists for retaining the recording.

Due to technical and operational requirements, including system backups and security safeguards, there may be a delay between when you request deletion and when all copies of your data are permanently deleted from backup systems. Such data is not actively processed during this period and is automatically deleted in accordance with our retention policies.

User Sharing of Platform Content

Match videos and performance content generated on the Platform contain personal data of all players participating in a session. Where a user downloads or shares such content outside the Platform, that user is solely responsible for ensuring they have obtained the necessary consent from all other players featured in the content before sharing it publicly, including on social media platforms or messaging applications.

Dream Play is not responsible for, and expressly disclaims liability in connection with, any downstream sharing, distribution, or publication of Platform content by users. Any such sharing by a user in violation of the rights of other players or in breach of Dream Play's Terms and Conditions may result in account suspension or termination, and the user shall indemnify Dream Play against any claims arising from such sharing.

Inactivity

Definition of Inactivity

An account shall be deemed “Inactive” if, for a continuous period of 24 months, the User has not:

  • Logged into their Dream Play account;
  • Uploaded, accessed, or reviewed match, performance, or analytics data;
  • Participated in any recorded match or session in a Dream Play-enabled court/venue; or
  • Engaged in any transaction or subscription-related activity (if applicable).

Notice Prior to Deletion

Upon an account being classified as Inactive:

  • Dream Play may notify the User at their registered email address.
  • If no activity occurs within 30 (thirty) days of such notice, Dream Play may proceed with account deactivation and data handling as set out below.

Failure to deliver notice due to outdated contact details shall not prevent Dream Play from acting under this clause.

Data Handling Upon Inactivity

Following expiry of the notice period:

  • Account Data: User account access may be disabled or deleted.
  • Personal Data: Personal data will be (a) deleted; or (b) irreversibly anonymised in accordance with the terms of this Privacy Policy.

Performance & Analytics Data: Match statistics and performance data generated in relation to a particular game may be retained for the purpose of generating and sharing match reports with other Users who participated in the same game session. Such data may also be retained in anonymised and aggregated form for research, product improvement, benchmarking, and statistical analysis.

Reactivation

If a User logs in or otherwise resumes activity prior to deletion, the inactivity period shall reset. Dream Play shall not be obligated to restore data once permanently deleted.

Applicable Law and Jurisdiction

By visiting this Platform, You agree that the laws of the Republic of India without regard to its conflict of laws principles, govern this Privacy Policy and any dispute arising in respect hereof shall be subject to and governed by the dispute resolution process set out in the Terms.

Updating Information

You will promptly notify Us if there are any changes, updates or modifications to Your personal information. Further, You may also review, update or modify Your personal information and User preferences by logging into Your profile page on the Platform.

Notice

We may update this Privacy Policy from time to time. Material changes will be notified through the Platform or other appropriate means. Continued use of the Platform after such updates constitutes acceptance of the revised Privacy Policy.

Grievance Officer

You may also receive such notifications regarding any marketing / promotional activities that maybe available on the Platform from time to time. By accepting these Terms, you explicitly consent to receive news, updates, offers/ campaign, marketing/ promotional communications (through call, SMS, email or other digital and electronic means) from us and/or our authorized representatives regarding any new services or offerings, even if your contact number is registered under the DND/NCPR list under the Telecom Commercial Communications Customer Preference Regulations, 2018.

You can unsubscribe / opt-out from receiving marketing/ promotional communications, newsletters and other notifications from us at any time by following the instructions set out in such communications.

  • We may share User Content and Company Content - including DPR and performance analytics generated from your match sessions, with tournament organiser or sports venue operators who have sought Dream Play’s services for the purpose of recording, processing, and analysis of match sessions at their facilities ("Partners"). Company Content may be shared with Partners for purposes connected to or reasonably arising from their role as a Dream Play partner venue, including without limitation: (i) managing and improving the player experience and quality of play at their facility; (ii) communicating with players regarding their performance, rankings, session history, or participation opportunities at that venue or across affiliated venues; (iii) organising, administering, or facilitating participation in tournaments, events, leagues, or competitive programmes, whether at a single venue or across multiple Partner venues within a region; (iv) identifying and inviting players based on their skill level, ranking, or performance metrics for participation in such programmes; and (v) any other purpose reasonably necessary for the internal management and operation of their facility or their participation in the Dream Play partner network. Partners are not permitted to use DPRs for independent commercial exploitation, disclosure to unaffiliated third parties outside the Dream Play partner network, or the development or training of machine learning or artificial intelligence systems, without the prior written consent of Dream Play.

The Company reserves the right to commercialise Company Content including data and insights derived from match sessions, performance analytics, skill scores, DPRs, usage patterns, and other content generated on or through the Platform ("Anonymised Data"), including by licensing or otherwise making available such Anonymised Data to third parties. Prior to any such commercialisation, the Company shall ensure that such data is anonymised such that it does not constitute personal data of the User. The Company does not sell personal data. The Company's right to commercialise Anonymised Data is not affected by, and shall survive, the deactivation, deletion, or termination of your Account, provided that data derived from your sessions has been anonymised prior to such commercialisation. By using the Platform, you acknowledge and agree that the Company may exercise these commercialisation rights without further notice to or consent from you.

Community and Group Features

  1. Where you voluntarily opt in to community or group features on the Platform (including participation in third-party messaging groups such as WhatsApp), your contact details, including your phone number, may become visible to other participants in that community or group. Company does not independently "share" your contact details in such cases and visibility arises from your participation in the group itself. Participation is entirely voluntary, requires your affirmative action, and you may opt out at any time by contacting us at contactus@dreamplayai.com or through the relevant feature in the Platform. Opting out will result in your removal from the relevant group or community feature, and your contact details will no longer be accessible to other participants through that channel.
  2. You shall indemnify the Company against all types of losses and damages incurred by us due to any action taken by TRAI, Access Providers (as defined under the TRAI regulations) or any other applicable authority due to any erroneous complaint raised by You against us with respect to the communications mentioned above or due to an incorrect contact number or email address being provided by You for any reason whatsoever.

We may also include links to other websites. Such websites are governed by their respective privacy policies, which are beyond Our control. Once the User(s) leaves Our servers (the User can tell where he/she is by checking the URL in the location bar on the User's browser), use of any information provided by the User is governed by the privacy policy of the operator of the site which the User is visiting. That policy may differ from Our Privacy Policy. If the User can't find the privacy policy of any of these sites via a link from the site's homepage, the User may contact the site directly for more information. We are not responsible for the privacy practices or the content of such third-party websites.

We implement reasonable technical and organisational measures, including encryption, secure servers, access controls, and periodic security reviews, to protect your information. While we strive to protect your data, no system can be guaranteed to be completely secure, and we cannot ensure or warrant absolute security. Thus, We cannot guarantee the security of Our database, nor can We guarantee that information You supply will not be intercepted while being transmitted to Us over the internet. Further, any information You include in a posting to the discussion areas will be available to anyone with internet access.

Advertising

When We present information to Our online advertisers to help them understand Our audience and confirm the value of advertising on the Platform - it is usually in the form of aggregated anonymized data (information that cannot be used to trace a user) of User(s) that may include statistics and/or data concerning User traffic, User responsiveness and User behaviour to such advertisements on Our Platform. When You register with Us, We may contact You from time to time about updating Your content to provide features which We believe may benefit You.

Beware of deceptive emails, websites, or messages claiming to be from or associated with Our Platform. Retention of Data

User Account Deactivation, Deletion and Retention

Depending on your location, you may have the right to access, correct, update, delete, restrict, or object to the processing of your personal information, withdraw consent, and request data portability. Temporary Deactivation

Users may request temporary deactivation of their Account. During temporary deactivation:

  • you will not be able to log into or use the Platform; and
  • your account data and personal information will be retained in an inactive state.

You may request reactivation of a temporarily deactivated Account at any time, subject to verification, and your account data will be restored as it existed prior to deactivation.

Account Deletion and Grace Period

If you request deletion of your Account, your Account will be scheduled for deletion and you will lose access to the Platform and the Services.

Following your deletion request, your Account data will be placed into a restricted state and will no longer be actively processed. We retain such data for a limited grace period of up to one hundred and eighty (180) days to:

  • protect against accidental or unauthorised deletion requests;
  • allow you to cancel the deletion and reactivate your Account;
  • maintain the security and integrity of our systems; and
  • comply with applicable legal, accounting, or dispute-resolution obligations.

During this grace period, you may cancel the deletion and reactivate your Account by logging back in using your registered credentials. Customer support intervention is not required for such reactivation.

Once the grace period expires, your Account and associated personal information will be permanently and irreversibly deleted or anonymised, and reactivation will no longer be possible, except where retention is required by law.

Deletion Process and Backups

When you request deletion of your data, we follow a deletion process designed to ensure your data is securely and completely removed from our active systems or retained only in anonymised form.

Shared Match Videos

Match videos recorded on Dream Play courts capture the personal data of all players participating in the session. Because each video is shared across all participants in that session, it simultaneously constitutes the personal data of every player recorded in it.

Notwithstanding anything to the contrary contained herein, where one or more of the other players in your session have requested access to the video  whether to view it or to have it processed for their own analytics and performance statistics we will be unable to action your deletion request in full while those players retain a legitimate basis for continued access. This is because deleting the video would extinguish the independent rights of other identifiable Data Principals who share an equal interest in the same recording, for the same purpose for which it was collected. In such cases, we will:

  • Restrict use of your personal data to fulfilling the access and processing entitlements of the other players in your session, and for no other purpose; and
  • Action your deletion request (full deletion or anonymisation (where feasible)) in full once all other players in the session have either deleted the video from their accounts or their retention period has expired, and no further legitimate basis exists for retaining the recording.

Due to technical and operational requirements, including system backups and security safeguards, there may be a delay between when you request deletion and when all copies of your data are permanently deleted from backup systems. Such data is not actively processed during this period and is automatically deleted in accordance with our retention policies.

User Sharing of Platform Content

Match videos and performance content generated on the Platform contain personal data of all players participating in a session. Where a user downloads or shares such content outside the Platform, that user is solely responsible for ensuring they have obtained the necessary consent from all other players featured in the content before sharing it publicly, including on social media platforms or messaging applications.

Dream Play is not responsible for, and expressly disclaims liability in connection with, any downstream sharing, distribution, or publication of Platform content by users. Any such sharing by a user in violation of the rights of other players or in breach of Dream Play's Terms and Conditions may result in account suspension or termination, and the user shall indemnify Dream Play against any claims arising from such sharing.

Inactivity

Definition of Inactivity

An account shall be deemed “Inactive” if, for a continuous period of 24 months, the User has not:

  • Logged into their Dream Play account;
  • Uploaded, accessed, or reviewed match, performance, or analytics data;
  • Participated in any recorded match or session in a Dream Play-enabled court/venue; or
  • Engaged in any transaction or subscription-related activity (if applicable).

Notice Prior to Deletion

Upon an account being classified as Inactive:

  • Dream Play may notify the User at their registered email address.
  • If no activity occurs within 30 (thirty) days of such notice, Dream Play may proceed with account deactivation and data handling as set out below.

Failure to deliver notice due to outdated contact details shall not prevent Dream Play from acting under this clause.

Data Handling Upon Inactivity

Following expiry of the notice period:

  • Account Data: User account access may be disabled or deleted.
  • Personal Data: Personal data will be (a) deleted; or (b) irreversibly anonymised in accordance with the terms of this Privacy Policy.

Performance & Analytics Data: Match statistics and performance data generated in relation to a particular game may be retained for the purpose of generating and sharing match reports with other Users who participated in the same game session. Such data may also be retained in anonymised and aggregated form for research, product improvement, benchmarking, and statistical analysis.

Reactivation

If a User logs in or otherwise resumes activity prior to deletion, the inactivity period shall reset. Dream Play shall not be obligated to restore data once permanently deleted.

Applicable Law and Jurisdiction

By visiting this Platform, You agree that the laws of the Republic of India without regard to its conflict of laws principles, govern this Privacy Policy and any dispute arising in respect hereof shall be subject to and governed by the dispute resolution process set out in the Terms.

Updating Information

You will promptly notify Us if there are any changes, updates or modifications to Your personal information. Further, You may also review, update or modify Your personal information and User preferences by logging into Your profile page on the Platform.

Company Content may be shared with Partners for purposes connected to or reasonably arising from their role as a Dream Play partner venue, including without limitation: (i) managing and improving the player experience and quality of play at their facility; (ii) communicating with players regarding their performance, rankings, session history, or participation opportunities at that venue or across affiliated venues; (iii) organising, administering, or facilitating participation in tournaments, events, leagues, or competitive programmes, whether at a single venue or across multiple Partner venues within a region; (iv) identifying and inviting players based on their skill level, ranking, or performance metrics for participation in such programmes; and (v) any other purpose reasonably necessary for the internal management and operation of their facility or their participation in the Dream Play partner network. Partners are not permitted to use DPRs for independent commercial exploitation, disclosure to unaffiliated third parties outside the Dream Play partner network, or the development or training of machine learning or artificial intelligence systems, without the prior written consent of Dream Play.

The Company reserves the right to commercialise Company Content including data and insights derived from match sessions, performance analytics, skill scores, DPRs, usage patterns, and other content generated on or through the Platform ("Anonymised Data"), including by licensing or otherwise making available such Anonymised Data to third parties. Prior to any such commercialisation, the Company shall ensure that such data is anonymised such that it does not constitute personal data of the User. The Company does not sell personal data. The Company's right to commercialise Anonymised Data is not affected by, and shall survive, the deactivation, deletion, or termination of your Account, provided that data derived from your sessions has been anonymised prior to such commercialisation. By using the Platform, you acknowledge and agree that the Company may exercise these commercialisation rights without further notice to or consent from you.

Community and Group Features

  1. Where you voluntarily opt in to community or group features on the Platform (including participation in third-party messaging groups such as WhatsApp), your contact details, including your phone number, may become visible to other participants in that community or group. Company does not independently "share" your contact details in such cases and visibility arises from your participation in the group itself. Participation is entirely voluntary, requires your affirmative action, and you may opt out at any time by contacting us at contactus@dreamplayai.com or through the relevant feature in the Platform. Opting out will result in your removal from the relevant group or community feature, and your contact details will no longer be accessible to other participants through that channel.
  2. You shall indemnify the Company against all types of losses and damages incurred by us due to any action taken by TRAI, Access Providers (as defined under the TRAI regulations) or any other applicable authority due to any erroneous complaint raised by You against us with respect to the communications mentioned above or due to an incorrect contact number or email address being provided by You for any reason whatsoever.

We may also include links to other websites. Such websites are governed by their respective privacy policies, which are beyond Our control. Once the User(s) leaves Our servers (the User can tell where he/she is by checking the URL in the location bar on the User's browser), use of any information provided by the User is governed by the privacy policy of the operator of the site which the User is visiting. That policy may differ from Our Privacy Policy. If the User can't find the privacy policy of any of these sites via a link from the site's homepage, the User may contact the site directly for more information. We are not responsible for the privacy practices or the content of such third-party websites.

Security Procedures

We implement reasonable technical and organisational measures, including encryption, secure servers, access controls, and periodic security reviews, to protect your information. While we strive to protect your data, no system can be guaranteed to be completely secure, and we cannot ensure or warrant absolute security. Thus, We cannot guarantee the security of Our database, nor can We guarantee that information You supply will not be intercepted while being transmitted to Us over the internet. Further, any information You include in a posting to the discussion areas will be available to anyone with internet access.

Advertising

When We present information to Our online advertisers to help them understand Our audience and confirm the value of advertising on the Platform - it is usually in the form of aggregated anonymized data (information that cannot be used to trace a user) of User(s) that may include statistics and/or data concerning User traffic, User responsiveness and User behaviour to such advertisements on Our Platform. When You register with Us, We may contact You from time to time about updating Your content to provide features which We believe may benefit You.

Beware of deceptive emails, websites, or messages claiming to be from or associated with Our Platform. These may misuse our name, logo, or content and attempt to collect personal information, payments, or promote unauthorized activities. Such communications are not connected to Us in any way. For Your safety, please verify authenticity before responding. We are not responsible for any loss or damage arising from reliance on such deceptive communications. Except as outlined in Our Terms, we will never ask You to share sensitive personal information.

WE DO NOT WARRANT THAT THIS PLATFORM, OUR SERVERS, OR EMAIL SENT BY US OR ON OUR BEHALF ARE VIRUS FREE. WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM OR RELATING TO THE USE OF THIS PLATFORM, INCLUDING, BUT NOT LIMITED TO COMPENSATORY, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL AND CONSEQUENTIAL DAMAGES, LOSS OR CORRUPTION OF DATA, GOODWILL, BUSINESS OPPORTUNITY, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES.

Retention of Data

User Account Deactivation, Deletion and Retention

Temporary Deactivation

Users may request temporary deactivation of their Account. During temporary deactivation:

  • you will not be able to log into or use the Platform; and
  • your account data and personal information will be retained in an inactive state.

You may request reactivation of a temporarily deactivated Account at any time, subject to verification, and your account data will be restored as it existed prior to deactivation.

Account Deletion and Grace Period

If you request deletion of your Account, your Account will be scheduled for deletion and you will lose access to the Platform and the Services.

Following your deletion request, your Account data will be placed into a restricted state and will no longer be actively processed. We retain such data for a limited grace period of up to one hundred and eighty (180) days to:

  • protect against accidental or unauthorised deletion requests;
  • allow you to cancel the deletion and reactivate your Account;
  • maintain the security and integrity of our systems; and
  • comply with applicable legal, accounting, or dispute-resolution obligations.

During this grace period, you may cancel the deletion and reactivate your Account by logging back in using your registered credentials. Customer support intervention is not required for such reactivation.

Once the grace period expires, your Account and associated personal information will be permanently and irreversibly deleted or anonymised, and reactivation will no longer be possible, except where retention is required by law.

Deletion Process and Backups

When you request deletion of your data, we follow a deletion process designed to ensure your data is securely and completely removed from our active systems or retained only in anonymised form.

Shared Match Videos

Match videos recorded on Dream Play courts capture the personal data of all players participating in the session. Because each video is shared across all participants in that session, it simultaneously constitutes the personal data of every player recorded in it.

Notwithstanding anything to the contrary contained herein, where one or more of the other players in your session have requested access to the video  whether to view it or to have it processed for their own analytics and performance statistics we will be unable to action your deletion request in full while those players retain a legitimate basis for continued access. This is because deleting the video would extinguish the independent rights of other identifiable Data Principals who share an equal interest in the same recording, for the same purpose for which it was collected. In such cases, we will:

  • Restrict use of your personal data to fulfilling the access and processing entitlements of the other players in your session, and for no other purpose; and
  • Action your deletion request (full deletion or anonymisation (where feasible)) in full once all other players in the session have either deleted the video from their accounts or their retention period has expired, and no further legitimate basis exists for retaining the recording.

Due to technical and operational requirements, including system backups and security safeguards, there may be a delay between when you request deletion and when all copies of your data are permanently deleted from backup systems. Such data is not actively processed during this period and is automatically deleted in accordance with our retention policies.

User Sharing of Platform Content

Match videos and performance content generated on the Platform contain personal data of all players participating in a session. Where a user downloads or shares such content outside the Platform, that user is solely responsible for ensuring they have obtained the necessary consent from all other players featured in the content before sharing it publicly, including on social media platforms or messaging applications.

Dream Play is not responsible for, and expressly disclaims liability in connection with, any downstream sharing, distribution, or publication of Platform content by users. Any such sharing by a user in violation of the rights of other players or in breach of Dream Play's Terms and Conditions may result in account suspension or termination, and the user shall indemnify Dream Play against any claims arising from such sharing.

Inactivity

Definition of Inactivity

An account shall be deemed “Inactive” if, for a continuous period of 24 months, the User has not:

  • Logged into their Dream Play account;
  • Uploaded, accessed, or reviewed match, performance, or analytics data;
  • Participated in any recorded match or session in a Dream Play-enabled court/venue; or
  • Engaged in any transaction or subscription-related activity (if applicable).

Notice Prior to Deletion

Upon an account being classified as Inactive:

  • Dream Play may notify the User at their registered email address.
  • If no activity occurs within 30 (thirty) days of such notice, Dream Play may proceed with account deactivation and data handling as set out below.

Failure to deliver notice due to outdated contact details shall not prevent Dream Play from acting under this clause.

Data Handling Upon Inactivity

Following expiry of the notice period:

  • Account Data: User account access may be disabled or deleted.
  • Personal Data: Personal data will be (a) deleted; or (b) irreversibly anonymised in accordance with the terms of this Privacy Policy.

Performance & Analytics Data: Match statistics and performance data generated in relation to a particular game may be retained for the purpose of generating and sharing match reports with other Users who participated in the same game session. Such data may also be retained in anonymised and aggregated form for research, product improvement, benchmarking, and statistical analysis.

Reactivation

If a User logs in or otherwise resumes activity prior to deletion, the inactivity period shall reset. Dream Play shall not be obligated to restore data once permanently deleted.

Applicable Law and Jurisdiction

By visiting this Platform, You agree that the laws of the Republic of India without regard to its conflict of laws principles, govern this Privacy Policy and any dispute arising in respect hereof shall be subject to and governed by the dispute resolution process set out in the Terms.

Updating Information

You will promptly notify Us if there are any changes, updates or modifications to Your personal information. Further, You may also review, update or modify Your personal information and User preferences by logging into Your profile page on the Platform.

Notice

We may update this Privacy Policy from time to time. Material changes will be notified through the Platform or other appropriate means. Continued use of the Platform after such updates constitutes acceptance of the revised Privacy Policy.
